Metro Transit, Inc., dba Lync Transportations (“We” or “Us”), the owner of the Lync a Ride Driver app and related platform and the Lync a Ride Passenger app and related platform (collectively, the “App”), respects the privacy of everyone who uses App (“you” or “Users”). This Privacy Policy explains how we collect, process, and store your personal information.

Introduction

We provide a communication platform to connect and match persons who are in need of transportation (“Customers”) with persons who are offering to provide transportation (“Drivers”) through the App (collectively, the “Service"). The Service we offer expressly does not include any transportation or delivery (including moving or hauling) services; we only provide the Service as defined above.

By installing, using or otherwise accessing the App and/or Service, you acknowledge that you accept the practices and policies outlined in this Privacy Policy. Your use of the App and/or Service, and any dispute over privacy, is subject to this Privacy Policy, our Terms of Service (“Terms”), including their applicable limitations on damages and the resolution of disputes, and our Driver Agreement (if applicable). The Terms and the Driver Agreement are incorporated by reference into this Privacy Policy. If you do not agree to this Privacy Policy, the Terms of Service, or the Driver Agreement (if applicable), please do not use the App and/or Service.

1. What Information We Collect About You

The information we may collect about you is described in this section, and includes data related to your account registration, payment, and security, such as your email address and credit card information, as well as information you provide us with voluntarily, such as your telephone number and address (collectively, the “Personal Information”). We may collect Personal Information directly from you, from third parties, or automatically through your use of the App and Service.

Information We Collect Directly.

  • If you wish to use the App and Service, we require you to provide us with your email address, credit card information, bank account information (in the case of Drivers), driving history (in the case of Drivers), driver's license number (in the case of Drivers) and telephone number.
  • We use the GPS location service through your mobile carrier or computer device to help us determine your location. We collect this information and use it to assist in providing the Service.
  • We collect information which you enter directly into the App, including your name, and your location.
  • Should you choose to directly contact us, we will collect your name and any contact information you may provide us with.

Information We Collect Automatically.

We automatically collect analytic information related to how users use the App and the Service on an aggregate and anonymous basis. We may use Google Analytics to collect this information.

Information We Collect Passively.

We use cookies and other tracking mechanisms to do such things as track information about your use of the App and the Service on an aggregate and anonymous basis so that we may recognize you and your device and improve the Service.

Cookies in General.

A cookie is a small amount of data, which often includes an anonymous unique identifier, which is sent to your computer or mobile device from the App or our website, and is stored in your computer or mobile device. For instance, cookies help us understand your preferences based on your previous or current Lync a Ride activity, which enables us to provide you with a better customer service experience. We also use cookies to help us compile aggregate data about our website's traffic and interaction with the App so that we can offer better experiences and tools in the future. You can choose to have your computer or device warn you each time a cookie is being sent, or you can choose to turn off all cookies. If you turn off all cookies, some features of the App and Service will be disabled, and as such, your experience with the App and Service may be impacted.

Third-Party Cookies.

We may also engage third parties (the “Third Parties”) to track and analyze data from the App and the Service. In this case, we will use the data collected by the Third Parties to help us administer and improve the quality of the App and the Service, and to analyze usage. However, please be aware that despite our best efforts, no data security measures can guarantee 100% security. You agree that we are not responsible for lost, stolen, or compromised passwords or for any activity via unauthorized password activity.

5. Third-Parties

We may use several third-party services and applications to help run the App and Service, evaluate usage of the App and Service, improve the App and Service, and customize user experiences. These entities may use cookies and Personal Information shared in the manner described in their own Privacy Policy to perform their services. These third parties include software developers to improve and run the App and Services, secure credit card and e-commerce processing, account analytics, and storage and security companies.

The App may contain links to third-party websites and/or applications (the “Third-Party Links). Any access to and use of such Third-Party Links is not governed by this Privacy Policy, but instead is governed by the privacy policies of those Third-Party Links. We are not responsible for the information practices of such Third-Party Links.

If you post content using the App and Service, all of the information that you post will be made available to the public. We cannot prevent such information from being used in a manner that may violate this Privacy Policy, the law, or your personal privacy. As a result, you should never post any sensitive information using the App and the Service that you are not comfortable sharing with the public. We are not liable to you or any other person for any content or information you post using the App and the Service, or the use or disclosure of such content or information by other users or third parties.

8. Fair Information Practices Compliance

If a breach of data occurs with our App, we will notify you via email within thirty (30) business days of discovering the breach.

10. Do Not Track Signals and Minors

The App and the Service are for those over the age of 18. We do not knowingly collect or solicit any information from anyone under the age of 13. The App and Service and their respective features are not directed at children under the age of 13.
